End-User License Agreement

1. Agreement

This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and ApplianceOps ("Company") governing your use of the ApplianceOps field service management platform ("Service"). By creating an account or using the Service, you agree to be bound by this Agreement.

2. License Grant

Subject to the terms of this Agreement and payment of applicable subscription fees, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the ApplianceOps platform for your internal business operations related to appliance repair and field service management.

3. Subscription and Payment

Access to ApplianceOps requires a paid subscription. Subscription fees are billed monthly through PayPal. A free trial period may be offered to new users. You are responsible for all fees associated with your account, including additional user seats. Failure to maintain an active subscription will result in loss of access to the platform, though your data will be retained for 30 days.

4. Your Data

You retain full ownership of all data you enter into ApplianceOps, including but not limited to customer information, service records, invoices, parts inventory, and business settings. We do not claim any ownership rights over your business data. You are responsible for the accuracy and legality of the data you enter.

5. Acceptable Use

You agree to use ApplianceOps only for lawful business purposes. You may not: share your login credentials with unauthorized parties; attempt to reverse engineer, decompile, or modify the platform; use the Service to store or transmit malicious code; resell or sublicense access to the platform; or use the Service in any way that could damage, disable, or impair its operation.

6. Third-Party Integrations

ApplianceOps may integrate with third-party services including QuickBooks Online (Intuit), Google Drive, Stripe, and others. Your use of these integrations is subject to the respective third party's terms of service and privacy policies. We are not responsible for the availability, accuracy, or practices of third-party services. You authorize ApplianceOps to transmit your data to connected third-party services as necessary to provide the requested integration features.

7. Service Availability

We strive to maintain high availability of the ApplianceOps platform but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify you of planned maintenance in advance.

8. Limitation of Liability

To the maximum extent permitted by law, ApplianceOps shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will meet your specific requirements or that it will be error-free.

10. Termination

Either party may terminate this Agreement at any time. You may cancel your subscription through your account settings. We may terminate or suspend your access if you violate this Agreement. Upon termination, your right to use the Service ceases. Your data will be retained for 30 days after termination to allow for export.

11. Changes to This Agreement

We reserve the right to modify this Agreement at any time. We will notify you of material changes via email or through the platform. Your continued use of the Service after changes constitutes acceptance of the modified Agreement.

12. Governing Law

This Agreement shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.
